Terms of service

These Terms of Service ("Terms") govern access to the Flam Shopify application, generated media, storefront components, and related services (collectively, the "Service") provided by Flam ("Flam", "we", "us", or "our"). By installing, accessing, or using the Service on behalf of a business, you confirm that you have authority to bind that business to these Terms. If you do not agree, do not use the Service.

Service and pilot status

Flam provides tools that may generate, process, preview, package, and publish interactive product media. The Service is currently offered as a free pilot. Pilot features may be experimental, incomplete, unavailable, modified, limited, or discontinued. We do not promise any service level, uptime, support response time, continued availability, or preservation of generated content unless we expressly agree in writing.

We may introduce paid plans later, but we will not charge a merchant without the notice and approval required by Shopify and applicable law.

Generative output and merchant review

Generation is probabilistic. Output may differ materially from prompts, source images, product appearance, color, dimensions, texture, motion, branding, or the result a merchant expected. Output may contain visual defects, omissions, inconsistencies, similarities to other material, or inaccurate or inappropriate elements. Re-running the same request may produce a different result.

Every output is a draft until the merchant reviews and approves it. The merchant is solely responsible for checking factual accuracy, product representation, pricing context, claims, intellectual-property rights, advertising compliance, accessibility, and suitability before publishing. Flam does not guarantee that output is unique, non-infringing, error-free, commercially effective, or fit for any particular purpose, and does not guarantee sales, engagement, conversion, or other business results.

Merchant content and permissions

The merchant retains its rights in content it submits or selects ("Merchant Content"). The merchant grants Flam and its service providers a worldwide, non-exclusive, royalty-free license to host, copy, modify, transmit, generate from, display, and otherwise process Merchant Content solely to operate, secure, support, and improve the reliability of the Service.

The merchant represents that it has all rights, permissions, notices, and lawful bases required for Merchant Content and our processing of it. The merchant must not submit confidential information it is not authorized to disclose, customer personal data, payment data, biometric data, children's data, or content that infringes rights or violates law.

Subject to applicable law and third-party rights, Flam does not claim ownership of the merchant-specific generated output. Laws concerning ownership of AI-generated material vary, and Flam makes no representation that copyright or other exclusive rights will arise in any output.

Acceptable use

The merchant must not use the Service to create or distribute unlawful, deceptive, defamatory, discriminatory, harmful, obscene, infringing, counterfeit, malicious, or privacy-invasive material; impersonate others; misrepresent products; make unsubstantiated claims; introduce malware or unsafe scripts; bypass security or usage controls; interfere with the Service; scrape or reverse engineer it except where law expressly permits; or use the Service in a manner that violates Shopify's policies.

Storefront changes and backups

The merchant controls whether to enable and publish Flam storefront components. The merchant must preview changes, use a duplicate theme where appropriate, maintain backups, and confirm product selection and cart behavior. Themes and third-party apps can change independently and may conflict with the Service. The merchant is responsible for disabling the extension or reverting its configuration if an issue occurs.

Third-party services

The Service depends on Shopify and third-party hosting, generation, storage, processing, and delivery providers. Their systems, terms, and availability are outside Flam's control. Shopify is not a party to these Terms, does not sponsor Flam, and is not responsible for the Service. Use of Shopify remains subject to the merchant's agreement with Shopify.

Suspension and termination

We may restrict or suspend access when reasonably necessary to address security, abuse, legal risk, noncompliance, third-party service failure, or harm to Flam, Shopify, merchants, buyers, or others. The merchant may stop using the Service and uninstall the app at any time. On termination, licenses granted to operate the Service end, but provisions that by their nature should survive—including ownership, disclaimers, liability limits, indemnity, and dispute terms—will survive.

Disclaimer of warranties

To the maximum extent permitted by law, the Service and all output are provided "as is" and "as available." Flam disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and that errors or harmful components will be corrected. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Flam and its affiliates, personnel, and providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, sales, data, content, or business interruption, arising from or related to the Service or output, even if advised that such loss was possible.

To the maximum extent permitted by law, Flam's total aggregate liability arising from or related to the Service will not exceed the greater of the amount the merchant paid Flam for the Service during the six months before the event giving rise to liability or INR 10,000. These limits do not apply where liability cannot lawfully be limited.

Indemnity

To the extent permitted by law, the merchant will defend, indemnify, and hold harmless Flam and its affiliates, personnel, and providers from third-party claims, losses, and reasonable costs arising from Merchant Content, the merchant's published output, breach of these Terms, violation of law or third-party rights, or the merchant's storefront, products, advertising, or customer representations. Flam will provide reasonable notice and cooperation, and the merchant may not settle a claim in a way that admits fault by or imposes obligations on Flam without Flam's written consent.

Changes to these Terms

We may update these Terms to reflect changes to the Service, law, or risk. We will update the date above and provide additional notice where required. Continued use after an updated version becomes effective constitutes acceptance to the extent permitted by law.

Governing law and disputes

These Terms are governed by the laws applicable at Flam's registered office, without regard to conflict-of-law principles. Subject to any mandatory rights or jurisdiction, disputes will be submitted exclusively to the courts having jurisdiction over Flam's registered office. Before filing a claim, each party will make a good-faith effort for 30 days to resolve it by written notice.

General

These Terms and the Privacy Policy form the agreement concerning the Service. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. The merchant may not assign these Terms without our consent; Flam may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
